According to a Times of India report, the police had initially registered the case under ‘lesser’ sections like wrongful confinement and intentionally causing hurt, as alleged by his family. However, after the victim’s statement was recorded before a magistrate under Section 164 of the CrPC, sections related to rape along with the POCSO Act were added to the FIR. Dinesh Singh, SHO of Dhaurahara police station, said, “Since she did not have any ID, we were not sure whether she was a minor or not. We have now added IPC sections 324 (voluntarily causing hurt by using a dangerous weapon) and 376 (rape) with the POCSO Act.
Refuting the allegations of the victim’s family, SSP (Kheri) Ganesh Saha said, “We have filed an FIR based on the complaint of her family. The girl’s video statement was recorded, in which she did not make such serious allegations. We don’t know why he changed his statement in court. However, we have now started our investigation as per his allegations. Accused has been arrested. ‘(agency)
