The Bombay High Court has granted bail to the accused in a rape case, stating that the POCSO Act will not apply. The court reasoned that the alleged incident, said to have occurred at the crowded Juhu Chowpatty in Mumbai, couldn’t have happened in broad daylight. The High Court also noted that the victim, as per an X-ray report, was found to be over 19 years old at the time of the incident, thus ruling out the application of the POCSO Act. The accused, a watchman, was granted bail as charges had not yet been framed by the trial court. The victim had alleged that the accused forcibly raped her behind stones at the beach. (Agency)
